GLANDON Apartments AG: General Terms and Conditions of the “Rental agreement for furnished GLANDON apartments”
1. Scope
These “General Terms and Conditions” are an integral part of the rental agreement and shall govern the relationship between the tenant and GLANDON Apartments AG (hereinafter referred to as “GLANDON”).
2. General provisions
2.1 Contractual partner
GLANDON is not the contractual partner in the renting of the furnished apartments. The contractual partner is the owner of the respective property specified in the rental agreement. GLANDON shall assume responsibility for overseeing and maintaining the properties on behalf of the owners.
2.2 Tenant
Before entering into an agreement, the prospective tenant’s credit rating may be checked. The Landlord shall deem the use of the enquiry form to constitute proof of interest in order to obtain information relating to the credit check.
2.3 Fee for short-term stays
If a tenant rents a GLANDON apartment for a term of 30 to 90 days and does not register with the respective municipality, they shall pay a contractually agreed fee for short-term stays. If a tenant rents a GLANDON apartment for a term of 30 to 90 days, registers with the respective municipality and presents GLANDON with this registration, they shall pay a reduced, contractually agreed fee for short-term stays. Tenants who enter into a rental agreement for a term greater than 90 days must not pay this fee for short-terms stays. If the rental agreement is extended during the tenancy, the tenant shall not be entitled to a refund of the fee for short-term stays.
2.4 Business hours
Business hours are from 8.00 am to 12.00 pm and from 1.00 pm to 5.00 pm on Monday to Friday.
2.5 Handover of the property
The apartment shall be handed over in a clean and rentable condition. The tenant shall have access to the apartment from 2.00 pm on the day of the agreed start of the rental period. Check-in must take place before 5.00 pm. If the rental period begins on a Saturday, Sunday or a local public holiday, the handover shall take place on the next working day. If available, check-ins may also take place on weekends or public holidays subject to a surcharge.
2.6 Use of the property
The rental property may only be used for residential purposes by the persons listed in the agreement. In the event that too many people are staying in the property, the tenant may be charged for additional expenses and/or their lease may be terminated without notice. The tenant shall be obliged to comply with statutory registration deadlines and permits as well as to communicate the personal details of the current occupants of the apartment to the GLANDON management team.
2.7 Maintenance of the property
The tenant is prohibited from making any changes to the rental property. Should urgent repairs be required, the GLANDON management team must be contacted. In the event that the management team cannot be contacted and there is a threat of major damage, the tenant must act in good faith. If major repairs or renovations are performed by GLANDON, the tenant must be informed with one month’s advance notice. The tenant must tolerate necessary and urgent work that is necessary for the upkeep of the property.
2.8 Rent
Rent payments must be transferred prior to the start of the respective month. Payments can be made via credit card payment or bank transfer. All transaction fees shall be borne by the tenant.
2.9 Reminder fees and collection charges
As of the second reminder, a fee of CHF 40 will be charged to the tenant. Any collection fees shall be borne by the tenant.
2.10 Security deposits and the deposit facility
Upon conclusion of the agreement, a reservation fee will be charged by credit card. The deposit must be paid no later than the date on which the tenant moves into the apartment. The amount of the deposit depends on the category of the rented apartment. GLANDON shall not charge any fees for transactions originating from outside Switzerland. The reservation fee and deposit shall be refunded without any interest at the point in time at which the tenant moves out, provided there is no damage or outstanding payments. If the refunded deposit and reservation fee are to be transferred to a bank account outside of Switzerland, all banking fees shall be borne by the recipient. GLANDON reserves the right to charge the tenant for any damage caused by the tenant and to offset any outstanding payments against the deposit and reservation fee.
2.11 Subletting
The subletting of the leased premises or parking spaces requires the written consent of GLANDON.
2.12 Use
The apartment shall only be used for residential purposes and must not be used for commercial activities.
2.13 Right of access and inspection
Employees of the property administration team may enter the apartment for cleaning purposes on a regular basis. Upon providing 24-hour advance notice, the landlord and GLANDON shall have the right to enter the apartment with craftsmen or prospective tenants even if the tenant is not present.
2.14 Cleaning
Depending on the individual agreement, the rental property shall be cleaned two or four times a month. Exceptions must be governed in the agreement. Cleaning shall always take place on the same weekday. We cannot cater to requests for cleaning days due to resource constraints. Access to the apartment must be granted at least once per month. Should the tenant not comply with this, GLANDON shall have the right to terminate the rental agreement. Interim cleaning includes cleaning the apartment surfaces, cleaning the kitchen (if present) and the bathroom as well as changing the bed linen and towels. Refuse bags shall not be disposed of by cleaning staff, and private items shall not be tidied up/cleaned. The final cleaning of the apartment is included in the rent and takes a maximum of three hours. In the event of heavy soiling, the additional expenses connected with this shall be charged in accordance with the price list for additional services. During the last month of the rental term or during a one-month rental term, the second or fourth cleaning shall be considered to be the final cleaning.
2.15 Devices
The tenant shall be obliged to treat the electronic devices provided with due care and shall be liable for any damages incurred. In the event of any uncertainty, the tenant may request an instruction manual. In the event of damage, GLANDON must be informed immediately so that the defective device can be replaced.
2.16 Private appliances
Appliances that require a water connection, air-conditioning units, music equipment and additional cooking appliances may be permitted after consulting with the management.
2.17 Internet
Internet access shall be offered via Wi-Fi (wireless access to the internet) for three
web-browser-enabled devices per apartment. In the event of any disruptions to or outages of this service, GLANDON must offer a provisional solution within 48 hours (on working days). Please note that the speed of the internet may be affected by varying levels of heavy use of the internet, especially in the evening. GLANDON does not guarantee the speed or performance of the internet provider. Should you wish to use the internet for commercial purposes, we recommend obtaining a private connection from an internet service provider. GLANDON shall not be responsible for the tenant’s hardware or software. GLANDON’s hardware meets modern standards and is designed for the general use of the internet. The internet connection is not secure, and the tenant shall use this at their own risk. As a hot-spot operator, GLANDON shall store all telecommunications data traffic transmitted via the Wi-Fi network for up to six months and shall forward this to the authorities in the event of prosecution.
2.18 Smoking
Smoking is prohibited in the rooms as well as in the public areas of the building. Any repair and cleaning costs that result from the breach of this rule may be charged to the tenant.
2.19 Pets
Pets are not permitted.
2.20 Bicycles
Bicycles must not be stored in the apartment or on the balcony.
2.21 Missing keys/badges
In the event of lost keys/badges, the landlord shall be entitled to have the keys/badges and locking system replaced or modified at the tenant’s expense.
2.22 Liability insurance
Liability insurance is not compulsory; however, we strongly recommend that tenants take out such an insurance policy. The tenant shall be privately liable for any damage caused without any limitations.
2.23 Statutory radio and television reception fees (Serafe)
The tenant shall be obliged to pay this fee if they are officially registered a residence in Switzerland. In the event that the tenant registers an official place of residence in Switzerland, the tenant shall be responsible for paying statutory reception fees.
2.24 Termination
Open-ended rental agreements may be terminated with a notice period of 30 days to the end of the month. Termination must be made in writing by post and must bear the written signature of the tenant. Termination shall be based on the date of receipt at GLANDON.
2.25 Extraordinary termination
The tenant may hand back the apartment without observing a notice period. In the event that the landlord fails to find a new tenant, the current tenant shall owe rent until the end of the notice period. The tenant shall be exempt from paying this owed rent once a new tenant is found. In all cases, an administrative fee of CHF 150 shall be paid.
2.26 Termination before the start of the rental term
If the tenant would like to withdraw from the agreement before the start of the rental term, the rental agreement may be terminated with a notice period of 30 days to the end of the month. Termination must be made in writing by post and must bear the written signature of the tenant. Termination shall be based on the date of receipt at GLANDON. The reservation fee shall not be refunded.
2.27 Return of the property
The rental property shall be returned in a good and tidy condition. The tenant shall be liable for any damages that they cause during the rental term due to extraordinary wear and tear. No objects may be left behind in the apartment that were not in the apartment at the start of the rental term. The rental property shall be returned no later than by 10.00 am on the last day of the rental agreement. Should this day fall on a Saturday, Sunday or local public holiday, the rental property shall be returned on the next working day.
2.28 Additional costs
The tenant may be charged for any damage, excessive soiling, wear and tear, as well as for other additional expenses.
2.29 Termination of the agreement in the event of extraordinary circumstances
In the event of extraordinary circumstances such as default payment, serious damage to the property, improper use of the rental property or other intolerable situations, we reserve the right to terminate the rental agreement immediately. All costs connected with such a termination shall be charged to the tenant. The tenant shall not be entitled to a reimbursement of the costs incurred as a result of the extraordinary termination of the tenancy, as they caused the termination via their own actions.
2.30 Agreement
The agreement contains all of the agreements made. Any changes or subsequent agreements shall only be considered as valid if they have been confirmed in advance in writing by GLANDON.
3. Further provisions
3.1 Data protection
- The data required to complete the commercial transaction will be processed by GLANDON and saved, as necessary. The collection and processing of personal data complies with the provisions set out in the Swiss Act on Data Protection.
- The tenant expressly permits the landlord and GLANDON to collect, save and/or process in some other way and store/archive all of the (requisite and relevant) data in connection with this tenancy. Within the meaning and scope of the landlord’s and GLANDON’s commercial obligation to preserve records, this right shall remain in place even after the end of the tenancy.
- The landlord and GLANDON shall be entitled to send the tenant’s data to authorities, suppliers, public utility companies, etc. in order to fulfil reporting obligations/duties.
- If the landlord or GLANDON is contacted by third parties (e.g. authorities, energy suppliers, potential new landlord of the tenant) due to a request for information (e.g. reference for potential new landlords in the event the tenant enters into a rental agreement with a third party), the landlord and GLANDON may pass on the requested information to the requesting parties.
- The landlord and GLANDON may take generally applicable principles and standard serious business practices as a starting point for the verification of such a third-party interest in obtaining information. This right to disclose information shall be limited to genuine facts. Conjecture and/or personal opinions must be omitted. This information shall be issued as cautiously as possible.
3.2 Video surveillance
The public spaces of the property may be subject to video surveillance to ensure the security and the protection of personal property. Images are handled according to the prescribed data protection guidelines and are only handed over to the authorities if criminal activity is suspected.
3.3 Badge
Every time the badge is used to access the property, the event is recorded electronically. If a badge is lost, GLANDON must be informed of this by phone without delay so that it can disable the badge immediately. The loss shall be charged according to the price list for additional services.
3.4 Applicable law
The provisions of the rental agreement are subject to Swiss law. The place of jurisdiction is the location of the rental property.
3.5 The German-language version of the GTCs shall be definitive
In case of doubt or in the event of contradictions, the German-language version shall be definitive.
